THE WEST BENGAL SCHOOL SERVICE COMMISSION (AMENDMENT) ORDINANCE, 2012.

Whereas it is expedient to amend the West Bengal School Service Commission Act, 1997, for the purpose and in the manner hereinafter appearing;

And whereas the Legislative Assembly of the State of West Bengal is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;

The Governor is pleased, in exercise of the power conferred by clause (1) of article 213 of the Constitution of India, to make and promulgate the following Ordinance:—

1. Short title and commencement:
(1) This Ordinance may be called the West Bengal School Service Commission (Amendment) Ordinance, 2012.
(2) It shall come into force at once.

2. Insertion of new section after section 15 of West Ben. Act IV of 1997.
After section 15 of the West Bengal School Service Commission Act, 1997, the following section shall be inserted:—

‘Special provision for making exemption to school or certain schools.’

15A. Notwithstanding anything contained in section 15, the State Government may, by general or special order, exempt from the purview of the Act a school or certain schools established and administered by such charitable organisation, and subject to such conditions and restrictions, and for such period, as may be specified in that order.

(Section 2.)

Explanation.— For the purpose of this section, the expression “charitable organisation” means an organisation rendering humanitarian services to the society, donation to which shall qualify for deduction under section 80G of the Income Tax Act, 1961.’.

In the further guidelines for empanelled Health Care Units for Medical Treatment under WBHS, 2008 below letter bearing no. 11253 (80)-F (MED) dated 16.12.11 the following amendments may be incorporated:-

Guidelines for Medical Treatment under West Bengal Health Service

Guidelines for Medical Treatment under West Bengal Health Service

West Bengal Health Scheme beneficiaries often face a lot of problems e.g. Improper Medical facilities from empanelled hospitals / nursing homes, difficulties while reimbursement of medical bill for final settlement and co-operation from the Health Care Organizations as well in this regard. Previously Govt. of West Bengal issued a Guidelines to H.C.O’s vide Finance Department Notification No. 796-F (MED), dated 31.01.11. Govt. issued following further Guidelines for empanelled Health Care Organizations for Medical Treatment under the West Bengal Health Scheme, 2008 which may be appended with the previous one.

Non –Package Treatment:

1. Prior permission from the West Bengal Health Scheme Authority is required whenever treatment costs exceed Rs. 2,50,000/-.
2. All drugs prescribed should be in generic names as far as possible. If generic names are not used, the justification for use of branded drugs should be provided. Quality of drugs will not be acceptable as justification for the use of branded drugs. The pharmacy should endeavor to procure and supply the cheapest available generic form of the prescribed drug, keeping in view the quality of the drug procured.
3. The use of Antibiotics should always be as per the antibiotic policy of the Hospital and based on culture report. ‘Shot gun therapy’ should be strictly avoided. Whenever antibiotics costing more than Rs. 1000/- (One thousand) per dose are used, the Chief of the Hospital infection Control Committee (HICC) should be consulted and together the Consultant in charge of the case and the chief of the
   HICC should certify that the most cost effective evidence based antimicrobial treatment has been prescribed. The chief of the HICC should be consulted whenever a change in the antibiotic regimen is contemplated in such patients.
   4. Whenever the total cost of pharmaceuticals exceed Rs. 10000/- (Rs. Ten Thousand) daily, the Director Medical Services or equivalent shall be consulted and he, along with the Consultant in charge of the case, should certify that evidence based cost effective treatment has been prescribed in the case.
   5. In case of cancer chemotherapy whenever the cost of therapy per cycle exceeds Rs. 5000/- (Five Thousand), the prognosis of the patient is to be clearly mentioned along with the justification for the use of the chemotherapy drugs with regard to the expected survival/palliation of the patient.
   6. The bed rent shall include the cost of all special mattresses and other such equipments/ devices/ nebulization.
   7. The cost of investigations will be inclusive of cost drawing the samples. This also applies to estimation of blood glucose using glucometer.
   8. Consultation fees in the ICU/High Definition Unit will be provided for the treating Specialists/ Super Specialists only (Names of doctors with qualification are to be mentioned in the Bill).
   9. The use of disposables/consumables should be kept to the levels. The maximum allowable in all cases shall be (non package treatment):
   
   a. Gloves -10 pairs (all types included) per day
   b. Masks- 2 per day
   c. I. V. sets – 3 per week
   d. venflon or substitute 3 per week
   e. B. T. set -3 per week
   f. Urinary catheters (all types included) – 3 per week
   g. Urobag – 3 per week
   h. Suction catheter -1 per day
   i. Syringes -10 per day (all capacities included)
   10. For non adherence to the above guidelines, the additional costs will have to be deducted from the final bills of the HCO.
   11. In case of any discrepancy/difficulty, the West Bengal Health Scheme Authority is to be contacted prior to preparation of the final bill.

Package Treatment:

1. The main procedure done is to be shown as the initial package.
2. Sub procedures requiring substantial additional consumables, skill or operative time is to be shown as subsequent packages.
3. Not more than two packages should normally be performed or planned. Permission of the West Bengal Health Scheme Authority is necessary for more than three packages.
4. For minimally invasive cases becoming open cases, cost of minimally invasive surgery package will not be allowed for billing.
5. In case of dual chamber pacemaker implantation, the medical reason for the non suitability of single chamber pace maker is to be justified, not just that it is more physiologically suited. In case of implantation of drug eluting stent, multiple stenting, opinion of Cardiac Surgeon will be required whether Bye-pass Surgery or PTCA with stenting is medically suitable for the patient. If digital hearing aid is prescribed, the specific reason for conventional hearing aid not being medically suitable is to be mentioned. Permissions of the West Bengal Health Scheme Authority are to be taken in all the cases by the H.C.O.s in advance.

General:

1. Code Nos. of procedures and investigations must be mentioned in the Bill.
2. Name and qualification with Registration No. of the Specialists/ Super Specialists must be mentioned in the Essentiality Certificate.

In terms of Rule 2(1)(c) of West Bengal Right of Children to Free & Compulsory Education Rules, 2012, published in the Extra-ordinary Kolkata Gazette, dated 16.3.2012 vide Memo No. 323-SE(Law)/ES/S/1A-01/2009 dated 15.3.2012, the President, West Bengal Board of Secondary Education, has been pleased to notify for information of all concerned that ‘age for admission’ as defined in the rules, in respect of appropriate class will be as follows :

(i) for class I, the age of 6 years and above but less than 7 years of age;
(ii) for class II, the age of 7 years and above but less than 8 years of age;
(iii) for class III, the age of 8 years and above but less than 9 years of age;
(iv) for class IV, the age of 9 years and above but less than 10 years of age;
(v) for class V, the age of 10 years and above but less than 11 years of age;
(vi) for class VI, the age of 11 years and above but less than 12 years of age;
(vii) for class VII, the age of 12 years and above but less than 13 years of age;
(viii) for class VIII, the age of 13 years and above but less than 14 years of age;

However, this definition of age shall be applicable for admission in class I on or after academic year 2013.

Govt. order being No. 380-Edn (P) dt. 31st July, 1991 and order of W.B. Govt. being no. 1330-S.E.(S)/8B-11/05 dt. 28th October, 2005, candidates whose date of birth is within 31st October, 1999 are to be considered eligible to appear at the Madhyamik Pariksha (Secondary Examination), 2014. The School authorities are requested not to send names of students whose date of birth is beyond 31st October, 1999. No Registration Certificates will be prepared if the date of birth of any candidate is beyond 31st October, 1999. The above order is strictly followed.

Earlier Circular No. D.S.(E)/183/12 dt. 28.06.2012 in this connection is hereby cancelled.

ORDER

WHEREAS under Section 60(1)(k) of the West Bengal Primary Education Act, 1973 (Act XLIII of 1973) it is the duty of District Primary School Council in each district to appoint Teachers of Primary Schools under the jurisdiction of the respective Council subject to the prescribed conditions;

AND WHEREAS process of recruitment of Primary School Teachers against the vacancies was initiated by ail District Primary School Councils in West Bengal accordingly in 2009 and most of them had completed the same;

AND WHEREAS the District Primary School Councils of North 24 Parganas, South 24 Parganas, Howrah and Malda had failed to complete the recruitment process till now due to some unavoidable reasons;

AND WHEREAS the Chairmen, DPSCs of North 24-Parganas, South 24- Parganas, Howrah and Malda have detected serious irregularities in the recruitment examination;

AND WHEREAS the aforesaid Chairmen, District Primary School Councils have informed this Department severally that the irregularities found in the recruitment process are irreparable at this point of time;

AND WHEREAS the aforesaid Chairmen, District Primary School Councils have further observed that if the earlier process of recruitment of Primary School Teachers is allowed to be completed a large number deserving candidates will be prejudiced in the selection process and some under merited and undeserved candidates may be appointed which may cause serious loss to the development of Primary Education in the aforesaid four Districts and will be against the Government policy towards maintenance of transparency in the recruitment process of Primary Teachers and may accordingly cause serious public harm;

NOW THEREFORE, in exercise of the powers given under Section 107 of the West Bengal Primary Education Act, 1973 (Act XLIII of 1973) the Governor is pleased to order that the aforesaid recruitment examinations conducted by the District Primary School Councils of North 24-Parganas, South 24-Parganas, Malda and Howrah be cancelled and directs the respective Chairman of the concerned District Primary School Councils to conduct the recruitment examination de novo provided that only the eligible candidates who had applied for recruitment against the advertisement issued by the concerned District Primary School Councils and had appeared in the written examination are allowed to appear in the de novo examination and no separate fees are collected from them for appearing in such examinations. No other candidates except those who were allowed to appear in the earlier written recruitment examination conducted for the same purpose will be allowed to appear in the de novo written examination. The entire process must be completed and the final panel published by the respective District Primary School Councils within a period of 90 (ninety) days from the date of issue of this order.

ORDER

In terms of Order No. 455-SE(Pry) dated 15/07/2011, Voluntary Resource Persons (VRPs) working in Government aided Primary Schools (including Senior Madrasahas) have been re-designated as Para Teachers (Primary level) and have been / being engaged in terms of G.O. No. 886-SE(Pry) dated 16/11/2010.

In this regard an issue has been raised to the effect that the date of initial engagement as erstwhile VRP may be accepted for calculating the total length of engagement of such re-designated para-teachers for the purpose of granting the benefit of payment of Rs. 1.00 lakh after attaining the age of 60 years.

After careful consideration of the issue, it hereby ordered that the initial date of engagement as VRP be taken into consideration for calculating the total period of engagement under SSA, subject to availability proper records of initial engagement date and continuity of engagement.

All concerned be informed accordingly.

Duties, Remuneration and Leave Rules of Para Teacher

Order

Para teachers have been engaged under SSA from time to time in the State of West Bengal. To enhance their effectiveness following guidelines are being issued. This will be in supersession of all orders issued earlier in this regard:

1. Description of duties for Para teachers:

Para teachers will perform three major duties – (a) Remedial teaching (b) Child tracking (c) Teaching Learning Material (TLM) preparation for activity based learning in School.

During School hours, Para teachers will addresses first generation students who are in need of remedial teaching. They will ensure that the students are able to suitably comprehend and follow the lessons so that they would be able to compete with other students in the formal classes. The ability of Para teachers will be judged by the whether the marginalized students have been able to be mainstreamed with the fellow students according to formal class room standard.

The role of Para teacher is particularly important in the Schools in backward village where the teaching learning process suffers from various deficiencies. Besides they will be involved in introducing activity-based for strengthening fundamental concept particularly in the area of language and Mathematics.

Students with learning disadvantages need additional inputs to reach the standards of students of a formal class room. This will be the main activity and purpose of the engagement of Para teachers.

Under no circumstances the Para teacher be permitted to function in lieu of regular teachers. Action will be taken against Schools violating this norm as per the extant rules of the department.

2. No. of days a Para teachers is supposed to attend the School in a week:

A Para teacher will be in School for 4 (four) days in a week and will utilize remaining 2 (two) days to monitor dropout students and ensure community support for enrollment of children in Schools.

3. Renewal of the Contract of a Para teacher (Methodology):

Para teachers are presently renewed by the Village Education Committee / Ward Education Committee. Since these Committees are very large bodies, the respective School Level Monitoring Committee (SLMC) as defined under Notification No. 841-SE(Pry)/2D-1/2007 dated 07/08/08 & No. 840-SE(Pry)/2D-1/2007 dated 07/08/08 shall renew the contract of the Para teachers.

Before the contract of a Para teacher is renewed there will be an assessment on the basis of their performance in remedial teaching, child taking and in developing TLM. SIs will do this assessment through a process of objective indicators.

There will be a break of 1 (one) day before renewal of.

4. Remuneration of Para Teacher: *

Para teachers (Primary & Upper Primary) will get remuneration with enhanced rate from 1^st April, 2009 as per the norm given below:

5. Leave Rules:

Leave for the engaged Para teachers attached to primary & upper primary schools under SSA shall be as under:

Maternity Leave:

135 (One hundred thirty five) days maternity leave may be enjoyed by the lady Para teacher. Such leave may start two months before the date of delivery of the child and may continue after the date of delivery.

Further this leave period two is not mandatory. According to the convenience of the incumbent maternity leave may be availed. Such maternity leave shall be sanctioned by the School Level Monitoring Committee (SLMC) and Managing Committee for primary and upper primary respectively on production of medical certificate from a registered medical practitioner.

Casual Leave & Medical Leave:

All Para teachers may enjoy 12 days casual leave for urgent necessity and 7 days leave on medical ground.

If the span of Service of the incumbent is less than one year such leave shall be proportioned accordingly and it will be sanctioned by the Head of the Institutions.

The medical leave shall not be accumulated for the next year. It will lapse as soon as the contract is over.

6. Training allowance & certificates:

The training allowance will be paid as defined under SSA norms. A certificate also may be given to the participants after they appear at a test examination at the end of the training. DIET will be involved in the whole process of such examination at the end of the training.

This guideline has been issued with the approval of the Executive Committee, Paschim Banga Sarva Siksha Mission.

MEMORANDUM

Consequent upon exorbitant price hike of different commodities, the question of enhancement of honorarium of Para Teachers and Voluntary Resource Persons (VRP) working in different Primary / Upper Primary Schools and Siksha Bandhus and Special Educators working at different levels under SSA is under active consideration of this department.

Now after thorough examination of this Departments earlier Notification No. 134-SE(Pry)/55/Ped/PBSSM, dated 26/02/2009, Memo No. 65(20)/IED/PBSSM-09 date: 29/07/2009; and in terms of Finance Department U.O. No. Group P 1429 Dated 23/04/2010 it is hereby ordered that consolidated remunerations of the aforesaid contractual employees will be enhanced by 35% as shown below:

2. All the existing Para teachers and others will now be re-engaged by the Government Officials in the manner to be notified in due course for a period of 1 (One) year subject to renewal till they attain 60 years of age or till the Sarva Siksha Project is winded up, whichever is earlier. But no new Para teacher or other contractual employee shall be engaged by any authority except with prior written approval of this Deptt.

3. On attaining 60 years of age or winding up of this project the Para teachers or other contractual employee as shown above will be paid an exgratia Retirement Honorarium of Rs. 1 (One) Lakh only on lump sum basis.

This order shall come into force w.e.f. 01/06/2010.

Sir / Madam,

Please follow the guidelines stated below regarding correction in photograph / data occurred during registration / examination enrollment of students for VIII+ / X+ level STC, July ’2012 to December ’2012.

(1) Any request for correction in data (say Name, DOB etc) may be submitted in the prescribed format of “Request for Data Correction in Registration / Examination form” through email to scvet-wb@nic.in mentioning subject line of the mail <CORRECTION_VTC CODE> with a copy to Nodal Centre.

(2) In case where the photograph has been changed after uploading, the soft copy of the photograph (in JPEG format only) has to be sent through email to scvet-wb@nic.in mentioning subject line of the mail <PHOTO_VTC CODE>. The file name of the soft copy of photograph should be “VTC code-Trade-class roll no” Example – “6710-TMSR-09”; otherwise photograph will not be considered.

The above mails will have to be sent within 7 days from the last date of registration.

Final 50% Arrear Payment to State Govt. Employees

MEMORANDUM

In terms of rule 12 of the W.B.S.(ROPA) Rules, 2009 the arrears of pay to which a State Government employee is entitled to during the period from the 1st April, 2008 to 31st March, 2009 shall be paid in cash in three consecutive equal yearly instalments beginning from the year 2009-2010.

2. Accordingly in terms of Memo Nos. 3950-F dt. 27.05.2009, 7189-F(P), dt. 02.07.2010 and 8270-F(P), dt. 23.08.2011 the first, the second and the first 50% of the third instalment of arrear calculated as per item No.6 of this Department’s Memo No. 2728-F, dt. 07.04.2009 were released to the State Government employees on and from 1st August, 2009, 1st August, 2010 and 1st August, 2011 respectively.

3. Now, the undersigned is directed by order of the Governor to state that remaining 50% of the third instalment of arrear already calculated as per item no. 6 of this Department’s Memo No. 2728-F, dated 07.04.2009 will be paid to the State Government employees in the month of September, 2012.

Sir/Madam,

As per stipulation under Section 23(2) of RTE Act, 2009 all school teachers who are engaged for teaching in elementary classes shall possess the requisite minimum qualifications as prescribed by the competent authority and if the existing teacher do not have the said minimum qualifications they shall acquire such qualifications within a period of five years from the date of enforcement of the Act.

Now, being authorized by the Ministry of Human Resource Development, Government of India as the academic authority, the National Council for Teacher Education (NCTE) has prescribed the minimum qualifications of teachers vide Notification Nos. as stated above.

The State Government has meanwhile initiated all effective measure to upgrade the qualifications of the teachers who do not possess the same as per requirement of NCTE. It has been decided that enhancement of minimum academic qualifications of Pry. School Teachers will be done through National Institute of Open Schooling (NIOS) and West Bengal Council of Rabindra Open Schooling (WBCROS); and the responsibility of providing Teacher Training Course (D. El. Ed) will be vested upon West Bengal Broad of Primary Education (WBBPE) through open and distance learning (ODL) mode.

Now, this Department deems it necessary to clarify certain points on the relevant issues as furnished below:

1) Teachers appointed prior to 3 September, 2001 shall go by State Government norms and they need not have to up-grade their qualifications.

2) Teachers appointed between 3rd September, 2001 to 31st December, 2005 possessing academic qualification as per State Government norms and completed one yr/2yrs Teacher training course from State recognised Institutions are not required to enhance their qualifications as per note 2 under first schedule to the NCTE (Determination of minimum qualifications for Recruitment of Teachers in Schools) Regulation 2001 dt. 4th September,2001 published in terms of F. No. 9-2/2001/NCTE dated 03.09.2001.

3) Teachers appointed from 01.01.2006 onwards should possess at least 50% marks in H.S. Examination or equivalent (45% in case of candidates belonging to reserved category and Exempted Category) and 2 years Diploma in Teacher Training Course (D. El. Ed.); or should be Graduate from recognised University (with any percentage of marks) with 2 years Diploma in Elementary Education.

4) Primary school teachers appointed after 03.09.2001 having B. Ed or equivalent qualification shall be required to obtain 6 months Special Training to be conducted with the approval of the National Council for Teacher Education.

It is now clarified that any teaching personnel appointed on or after 03.09.2001 having deficiency in the aforesaid qualifications shall have to up-grade his/her academic qualification to the extent of 50% marks in H.S. (45% in case of reserved candidates as well as candidates belonging to Exempted category) if he/she is not a Graduate from a recognised university (with any percentage of marks); and thereafter/simultaneously he/she will have to undergo 2 years Diploma Course in Elementary Education. However if any candidate completes one yr. Course in Teacher Training from State recognised Institution on or before 31.12.2005, another one year’s Bridge Course in Teacher Education shall meet his Teacher Training requirement and same will be treated as equivalent to D. El. Ed.

It may further be clarified that if a candidate is deficient in both academic and teacher training qualifications, he/she will be allowed to pursue both courses simultaneously on the condition that final examination result of teacher training course will be withheld till attainment of 50% marks in Higher Secondary Examination.

It is presumed that you have already collected bio-data of all Pry. School teachers under your control in pursuance of this Department No. 277-SE (P)/10M-6/09 (Pt) dt. 28. 03. 2012. I would now request you to furnish a report on the following points as per proforma to this Department by 17.08.2012 positively.
